1. The site
The Tavern Arcade provides free, browser-playable games. No account, purchase or subscription is required. We may add, change, suspend or remove any game or feature at any time without notice.
2. Eligibility
The site is intended for users aged 13 and over (16 and over where that is the applicable age of digital consent). By using the site you confirm you meet that requirement. If you are under the age of majority where you live, please use the site with a parent or guardian's permission.
3. Acceptable use
You agree not to:
- Attempt to gain unauthorised access to the site, its servers, or any connected system
- Interfere with, overload, or disrupt the site or the experience of other players
- Use bots, scripts, memory editors or modified clients to submit false leaderboard scores
- Submit a display name that is obscene, hateful, harassing, impersonating, or that contains another person's private information
- Copy, scrape, mirror, reverse-engineer, decompile or redistribute the games or site code
- Frame or embed the games on another site without our written permission
- Remove, obscure, block or interfere with the advertising displayed on the site
- Use the site for anything unlawful or in breach of any applicable regulation
We may remove leaderboard entries, or block access, where these rules are broken. Score submissions that appear automated or impossible may be deleted without notice.
4. Intellectual property
All games, source code, artwork, characters, audio, text and branding on this site are the property of The Tavern Arcade and are protected by copyright and other intellectual property laws, except where third-party assets are used under licence.
You are granted a personal, non-exclusive, non-transferable, revocable licence to play the games for your own non-commercial entertainment through this website. That licence does not include any right to download, host, sell, sublicense, modify or create derivative works from the games.
Streaming and video content (including monetized let's-plays and reviews) is welcome and permitted, provided you credit The Tavern Arcade and do not present the games as your own.
5. Names you submit
When you enter a display name for a leaderboard, you grant us a non-exclusive, worldwide, royalty-free licence to display it publicly on the site. You are responsible for what you type. Do not enter your real full name, email address, phone number or any other personal detail — leaderboards are public. See the Privacy Policy for how this is handled.
6. Advertising
The site is supported by advertising served by Google and its partners. Advertisements are provided by third parties, and their appearance on this site is not an endorsement by us of the advertiser, its products or its claims. Any dealings you have with an advertiser are strictly between you and them. How advertising cookies work is set out in our Cookie Policy.
7. Donations
Voluntary cryptocurrency donations may be offered on the site. Donations are gifts, not purchases: they are non-refundable, unlock no content, confer no ownership, membership, or entitlement of any kind, and are not required to access any part of the arcade. Cryptocurrency transactions are irreversible; always verify an address before sending.
8. Third-party services and links
The site uses third-party services (including Google AdSense, Google Fonts and a leaderboard provider) and may link to external sites. We do not control those services and are not responsible for their content, availability, practices or policies.
9. Availability
We aim to keep the arcade open around the clock but make no guarantee of uninterrupted availability. Games, leaderboards, multiplayer servers and saved progress may be unavailable, reset or discontinued at any time. Locally saved game progress is stored in your own browser and can be lost if you clear your browser data — we cannot recover it.
10. Disclaimer of warranties
The site and the games are provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the site will be error-free, secure, or free of harmful components.
Health note: a small number of people may experience seizures when exposed to flashing lights or patterns. If you or anyone in your family has a history of epilepsy or seizures, consult a doctor before playing. Stop immediately and seek medical advice if you experience dizziness, altered vision, disorientation, or involuntary movement while playing. Take a break of 10–15 minutes every hour.
11. Limitation of liability
To the fullest extent permitted by law, The Tavern Arcade and anyone involved in creating or operating it will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising out of your use of or inability to use the site. Where liability cannot lawfully be excluded, it is limited to the greater of the amount you paid us in the previous twelve months (which for a free site is normally zero) or USD 50.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you, and this does not affect your statutory consumer rights.
12. Indemnity
You agree to indemnify and hold harmless The Tavern Arcade from any claim or demand, including reasonable legal fees, arising out of your breach of these terms or your misuse of the site.
13. Termination
We may restrict or terminate your access to the site at any time, without notice, if we reasonably believe you have breached these terms. Sections 4, 10, 11, 12 and 14 survive any termination.
14. Changes and governing law
We may revise these terms from time to time; the "Last updated" date shows the current version, and continued use after a change means you accept it. These terms are governed by the laws of the United States and of the state in which the operator resides, without regard to conflict-of-law rules. If any provision is found unenforceable, the rest remains in force.
